Welcome to Mengir! These Terms of Service govern your use of our platform, which connects Ethiopian and Eritrean communities through business listings, property sales, events, and community features. Please read these Terms carefully before using our services.

By accessing or using Mengir ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legally binding agreement between you and Mengir. We may modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.

2.1 Eligibility

• You must be at least 18 years old to use the Platform.
• You must provide accurate, complete, and current information.
• You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Responsibilities

• You are responsible for all activities under your account.
• Notify us immediately of any unauthorized access or security breach.
• One account per person; multiple accounts may be terminated.
• You may not transfer or sell your account to another party.

3.1 Your Content

You retain ownership of content you create (listings, events, posts, messages). By posting content, you grant Mengir a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

3.2 Content Standards

You agree not to post content that:

• Is false, misleading, or deceptive
• Infringes intellectual property rights of others
• Contains hate speech, harassment, or discrimination
• Promotes illegal activities or violence
• Contains malware, spam, or phishing attempts
• Violates any applicable laws or regulations

3.3 Listing Accuracy

You are solely responsible for the accuracy of your listings, including pricing, availability, descriptions, and images. Misrepresentation may result in account suspension or termination.

4.1 AI Content Policies

• Human Review Required

  You must review and verify all AI-generated content before publishing. You are responsible for its accuracy.

• Content Ownership

  AI-generated content created using your inputs belongs to you, subject to these Terms.

• No Guarantees

  AI-generated content is provided 'as is' without warranties of accuracy or fitness for any purpose.

• Usage Quotas

  AI generation features are subject to usage limits based on your subscription tier.

4.2 AI Usage Restrictions

You may not use AI features to generate content that violates these Terms, infringes third-party rights, or attempts to deceive users. AI-generated content must comply with all content standards.

5.1 Subscription Plans

• Billing

  Paid subscriptions are billed in advance on a monthly basis through Stripe.

• Auto-Renewal

  Subscriptions automatically renew unless cancelled before the renewal date.

• Price Changes

  We may change prices with 30 days notice. Changes apply at the next billing cycle.

5.2 Refund Policy

• Subscription Refunds

  Subscription fees are generally non-refundable. You may cancel at any time, but access continues until the end of the billing period.

• AI Generation Credits

  Used AI generation credits are non-refundable. Unused credits do not carry over between billing periods.

5.3 Payment Processing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's Terms of Service. We do not store complete payment card information.

The following activities are strictly prohibited:

• Creating multiple accounts to circumvent restrictions or bans
• Scraping, crawling, or automated data collection without permission
• Interfering with or disrupting the Platform's operation
• Attempting to gain unauthorized access to systems or accounts
• Using the Platform for money laundering or fraudulent transactions
• Impersonating others or misrepresenting your affiliation
• Circumventing payment systems or manipulating AI usage quotas
• Posting listings for illegal goods, services, or activities

7.1 By You

You may delete your account at any time through account settings. Upon deletion, your public content may be removed, but some information may be retained for legal or operational purposes.

7.2 By Us

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, illegal, or harmful activity
• Extended account inactivity (12+ months)
• Any reason with 30 days notice for accounts in good standing

8.1 Platform Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.

8.2 User Interactions

Mengir is a platform connecting users. We are not responsible for:

• The accuracy or quality of user-generated content or listings
• Transactions, agreements, or disputes between users
• The conduct or reliability of other users
• Any damages arising from user interactions

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENGIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9.1 Informal Resolution

Before filing any legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

9.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

9.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.

• Governing Law

  These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

• Entire Agreement

  These Terms, along with our Privacy Policy, constitute the entire agreement between you and Mengir.

• Severability

  If any provision is found unenforceable, the remaining provisions remain in effect.

• No Waiver

  Failure to enforce any right does not waive our ability to enforce it later.

• Assignment

  We may assign these Terms; you may not assign without our consent.
